Terms of Service
These terms apply to your use of FireFrag’s games, apps and website. We have tried to write them in plain language, and to stay out of your way.
01Acceptance of these terms
These Terms of Service (“Terms”) form a binding agreement between you and FireFrag, an independent developer (“FireFrag”, “we”, “us”), and apply to your access to and use of our games, apps and website (the “Services”).
By downloading, installing, accessing or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please stop using the Services.
If you accept these Terms on behalf of an organisation, you confirm that you are authorised to do so.
Business advertising and creative services are provided under a separate written agreement and are not governed by these consumer Terms.
02Who can use the Services
You must be old enough to enter into a binding contract where you live. If you are not, please do not use the Services.
03Licence to use the Services
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited licence to use the Services on lawful devices for non-commercial purposes.
You must not:
- Reverse engineer, decompile or disassemble the Services, or attempt to derive their source code;
- Modify, copy, distribute, sell, rent, sublicense or otherwise commercialise the Services or any part of them;
- Bypass, crack or circumvent payments, advertising, regional restrictions or other technical measures;
- Exploit bugs, use automation or unauthorised third-party tools to gain an unfair advantage;
- Scrape, crawl or send unreasonably frequent requests that interfere with the Services;
- Upload malicious code, or engage in unlawful, infringing or harmful conduct.
We may suspend or terminate a licence where we reasonably believe these Terms have been breached.
04Accounts
Where a game does not require an account, you can play without one. If a game offers an optional account, you are responsible for keeping your credentials secure and for activity under your account.
You can delete your account at any time in-game or by emailing support@firefrag.com. Deleting an account removes associated progress and cloud saves, and cannot be undone.
We may restrict or suspend an account if we detect unusual activity, fraud or a security risk.
05Virtual items and purchases
Where in-app purchases are offered, they are processed by Google Play or another payment channel we designate, and are also subject to that store’s terms. We never handle your full payment card details.
Where virtual items are offered, they grant you a limited licence to use them within the Services. They have no cash value and cannot be transferred, exchanged or refunded, except where required by applicable law or store policy.
Prices, content and available items may change. If we withdraw content you have purchased, we will offer a reasonable alternative or act as required by applicable law.
06Consumer withdrawal rights
If you are a consumer in the EEA or UK, you may have a 14-day right to withdraw from a purchase of digital content. The right is lost once you expressly consent to immediate delivery and acknowledge that you lose it, where the law allows.
To exercise a withdrawal right, contact support@firefrag.com. If you bought through Google Play, you can also use Google Play’s refund process. Nothing in these Terms limits mandatory consumer rights.
07Advertising and third parties
Some Services may be supported by advertising. Where ads are shown, they are supplied by third parties and subject to those parties’ own terms and privacy policies.
The Services may link to third-party websites or services. We are not responsible for their content, availability or security.
08Intellectual property
The Services and all content in them — including game code, level design, artwork, music, text, trademarks, logos and interfaces — are owned by FireFrag or our licensors and are protected by copyright, trademark and other laws.
You may not use our names, logos or game assets for any commercial purpose, or imply a partnership or endorsement, without our written permission.
If you send us feedback, suggestions or ideas, you grant us a non-exclusive, worldwide, royalty-free licence to use them to improve the Services.
09User content
If a Service lets you submit content (for example player-made levels, reviews or community posts), you retain ownership of it and grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to use, display and adapt it as necessary to operate and promote the Services.
You confirm that you have the rights needed to submit the content and that it does not infringe anyone’s intellectual property, privacy or other rights.
We may, but are not obliged to, review, edit or remove content that breaches these Terms.
10Disclaimer
The Services are provided “as is” and “as available”. We work hard to keep them stable and secure, but we cannot guarantee that they will be uninterrupted, error-free or meet your specific requirements.
Games, characters and storylines are fictional. Any resemblance to real places, people or events is coincidental.
Nothing in these Terms excludes or limits statutory rights that cannot be waived under your local consumer protection law.
11Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, punitive or consequential losses (including loss of profit or goodwill) arising from your use of, or inability to use, the Services.
To the fullest extent permitted by law, our total liability under these Terms will not exceed the greater of (a) the amount you actually paid for the relevant Services in the 12 months before the claim, or (b) US$100 (or the equivalent in your local currency).
Nothing in this section excludes liability for our wilful misconduct or gross negligence, personal injury, fraud, data protection breaches, or any liability that cannot lawfully be excluded.
12Termination
If you breach these Terms, we may suspend or terminate your right to use all or part of the Services. You may stop using the Services and delete the relevant apps at any time.
On termination, your licence to use the Services ends immediately. Provisions on intellectual property, disclaimers, limitation of liability and dispute resolution survive termination.
13Governing law and disputes
These Terms are governed by the laws of the country in which you reside, without regard to conflict-of-law rules. Nothing in these Terms limits any mandatory consumer protection rights you have under the law of your country of residence.
If a dispute arises out of or in connection with these Terms or the Services, the parties will first try to resolve it in good faith. If no resolution is reached within 30 days, either party may bring proceedings in the courts competent under applicable law.
If you are a consumer, you may also bring proceedings in the courts of your country of residence, and mandatory provisions of your local law prevail.
14Changes to these terms
We may update these Terms from time to time. The new version will be published on this page and the “Last updated” date at the top will change.
If a change materially affects your rights, we will give you reasonable advance notice in-game, by email or on this page. Where permitted by law, continuing to use the Services after the change takes effect means you accept the updated Terms; if you do not agree, you may stop using the Services before the change takes effect.
